Challenges before CNSC
Drafting and filing the challenge
Preparation of the challenge in compliance with admissibility requirements (deadlines, standing, bond) and with structured arguments on the unlawfulness of the acts issued by the contracting authority.
Challenging the evaluation result
When your offer has been unjustifiably rejected or when the winning bid does not meet the requirements, a challenge is filed against the evaluation result.
Challenging the tender documentation
When the documentation contains restrictive, discriminatory or disproportionate requirements that limit competition, the challenge may be filed before submission of the offer.
Supporting the challenge
Participation in CNSC hearings, filing additional documents, responses to the contracting authority’s or competing bidders’ submissions.
Posting the bond
Assistance in constituting the mandatory bond, which is a condition of admissibility of the challenge.
Court actions (administrative litigation)
Complaint against the CNSC decision
If CNSC dismisses the challenge, the decision may be appealed before the administrative court within 10 days.
Direct actions
In certain cases, the action may be filed directly before the court, without going through CNSC.
Suspension requests
Requests to suspend the award procedure or the performance of the contract, where continuation would cause irreversible damage.
